This is for California Surveyors. I am having a disagreement with a legal firm regarding the beginning wording to a condo plan that I am preparing. I propose:
AS PER MAP FILED IN BOOK xxx, PAGES xx THROUGH xx OF MAPS, IN THE OFFICE OF THE COUNTY RECORDER OF SAID COUNTY. DIAGRAMMATIC FLOOR PLANS OF THE BUILDING CONSTRUCTED ON SAID LOT AND PURSUANT TO THE PROVISIONS OF THE DAVIS-STERLING COMMON INTEREST DEVELOPMENT ACT, TITLE 6, PART 4 DIVISION SECOND OF THE CIVIL CODE.
The attorney wants me to have a specific reference to 'Code 4285'. I think that Davis-Sterling is broader and covers Code 4285, and that surveyors in California usually refer to Davis-Sterling. Any input would be appreciated.
