I understand the desire to see a graphical depiction of building/parking setbacks if they are clearly explained in a zoning report but so many times I'm also asked to copy most if not all of the information in the report onto the Survey.?ÿ My canned reply is "the Zoning Report stands on its own, adding the information in it to my Survey doesn't further validate it".?ÿ I think there's a perception out there that if they can get it on the Survey the Surveyor is somehow on the hook for the accuracy of this information.?ÿ I suppose if something really went sideways with a?ÿproperty because of a gross?ÿerror in the report and the information was also shown on the Survey the Surveyor could get taken to task in court but if the source of the information was plainly cited I don't see how any of the goo could stick.?ÿ Without being a total jerk and being mindful and desirous of repeat Clients (I get a lot of referrals from real estate attorneys) how do you all deal with these types of requests.?ÿ
I typically show the zoning requirements in graphical and chart form on an ALTA. Some items can't be shown graphically, so the chart or some other way is needed to represent them. I also reference the zoning report they are based on, so the survey doesn't validate it. Not that much extra work and it is easier to talk about those issues with the owner/buyer if it's on the map.
The zoning information is supposed to be provided to you. Cite the source and state that no research was performed. Graphic depiction isnt going to dig the hole any deeper...
I only show building setbacks on the map with regards to zoning requirements. The other elements I only show in the "Zoning Notes" section.
Graphic depiction of the setbacks disclosed in the report is the extent of what 6(b) contemplates and I don't have a problem showing that.?ÿ It's all the other stuff in the report that I'm regularly asked to add that bugs me.?ÿ Floor area ratios, parking ratios, landscape requirements, impervious minimums, ect.?ÿ I know it's really not that hard to copy and paste the info from the report onto my survey?ÿand maybe?ÿit's just the paranoid Surveyor in me but I constantly fight the feeling they're trying to pull a "gotcha".?ÿ
I guess just tell them to pay for 6(a) too and be done with the conversation.?ÿ

This is exactly what I do. Usually no more than a small table showing some of the information regarding parking and the zoning requirements. Once I was asked to do some shading on the drawing itself but so far, that's been a "one time" thing.
