ALTA Item 6(a) in your Contract

In proposals for ALTA Surveys, I state that the five pieces of information that need to be provided to us, as required for Item 6(a) , and I say "in a zoning report or letter". They like to include this item but then, at the end of the project, they send me the 150 page zoning code straight from the local jurisdiction. How do you state that the zoning report or letter are just that, NOT the zoning code? Thank you for any assistance...

That's not a zoning report, which is what 6(a) requires. I'm not, and the standards do not require me, to be liable for interpreting the zoning ordinance.

What I typically do in situations like yours, is put the zone on the survey, as shown on the zoning map. However, that is as far as I go. If they want more detailed information on the survey, they have to give it to me.

Same thing happened to me last year. I noted it like this

6b- Property is zoned R-MF multi family housing. Building setback requirements are: Front - 30' for single family and two family dwellings - 25' for multi family dwellings (see section 10.246 # 9 of the City of Confusion Development Ordinances), Side - 8' for single and two family dwellings - 25' for multi family dwellings (see section 10.247 of the City of Confusion Development Ordinances) , Side abutting street - 15' for single and two family dwellings - 25' for multi family dwellings (see section 10.247 of the City of Confusion Development Ordinances), Rear - 20% of the lot depth for single and two family dwellings, see notes 1 and 2 section 10.246
- 25' for multi family dwellings (see section 10.246 # 9 of the City of Confusion Development Ordinances) Height - 35' (for single-family and two family dwellings). Minimum lot area square feet - 7,000 for single family dwelling - 11,000 for two family dwellings - 15,000 for 3 dwelling units - 17,000 for 4 dwelling units; add 1500 for each dwelling unit in excess of 4. Minimum lot width - 60' for single family dwelling - 80' for two family dwellings - 95' for multi family dwellings. Floor space area - The total ground area covered by the buildings and all accessory buildings including any roofed area, shall not exceed 40% of the total lot area (see section 10.136 item #18). Requirements stated above are from the City of Confusion Development Ordinances, Section 10.245 Area, Height,and Yard Regulations dated June 1, 1999, Reference to this document and consultation with the City of Confusion should be made for full detail and further explanation of the requirements of the City of Confusion. Zoning classification was taken from a zoning letter from the City of Confusion dated September 19, 2014.

I'll list the zone if it's publically available on the GIS, as well as the address of zoning jurisdiction - and stage it came from the county GIS and give the link.

Anything more and they need to provide a report.

I believe in the new ALTA/NSPS standards, the zoning information is to be provided by the client. Be careful how you reference it's source, if you get it wrong and you are the source it could cost you.
