What a mess. It goes to show we can't blindly follow another Surveyors foot steps. I wonder if any licenses were lost over this. If the Surveyor of the 70's, was off that far, he/she should be liable (and flipping burgers maybe).
A classic example of why not to get lawyers involved. Everybody was happy until they discovered they may have owned something they didn't know they may have owned. Ok, the guy alledgely screwed up for whatever reason. Who knows, just fix the problem.
A simple re-plat by any surveyor would have fixed it all and life would be good. But noooooo, bring in the L word along with overly anal neighbors - and life gets complicated. These are stories that degrade our profession
I would like to invite Winona County Land Surveyor Pat Veraguth to join us here at BeerLeg/Connect.
Sounds like the 4 foot question has grown to 36...1960 is now 1975...etc. etc.

Would love to see the field notes from 1975 and 1998.
Too little information in this article to pass judgement on the '75 surveyors.
I have a hard time figuring out why no-one would have caught this in the span of all those years.I mean where are all the field checks?,side ties ect....
Very interesting.
That is a sizeable oops for sure. It makes me wonder if there were two unrelated bars 36 feet apart in 1975 and the surveyor at that time started from the wrong one. If not, is this a case of two surveyors having different opinions as to the true starting point for the survey? Something like the pipe and stone thread of Deral's?
Pipe or Stone...or maybe the '98 feller not following in the footsteps of the '75 feller. When was the famous Lot 80 created? I wish Mr. Pat Veraguth was here to help us out...
Lex's Mr. Jones was a 'what if'...this is real...History in the making...

Not sure which state. Why is it that all newspapers and TV stations, when they put up a web presence, just assume you know where their town is?
Anyway, does that state have a statute setting a time limit for acquiescence or repose?
Edit: after nosing around their site, I see that it is Minnesota.
mr graham, how do you find so many boundary related stories? i want to know; Boolean filters?
I can't speak for Derek, but I just use Google alerts for "land surveyor (ing)"
"property line", "boundary line dispute", etc., etc.
I use it to follow concerts/news of certain performers as well. Of course it's hard to follow along if your favorite performer is "John Smith"......:-S
Dan, it's not the stories
that degrade our profession.....
Dan, I mean Wayne
Sorry Dan.
