Nightmare client files suit. Due to pending litigation, that's all I have to say about that.

Sorry to hear that. I have made plenty of mistakes in my 30+ years of surveying. My practice is limited to new housing construction. Sometimes, (about 98%), I have found, that it is wise to meet with the client and try to work things ($) out rather than to resort to litigation. Don’t know your circumstances but wish you the best!

Liability or E & O Insurance

If you or your employer have Liability or E & O Insurance you will be fine as they will dispatch with such trivial items post haste. Did "Loser pays" make it through the latest round of Tort Reform here in Texas?

I think so. It will be interesting. This was simple survey with complicated factors that was vaguely described here previously. I'll leave it alone for the time being rather than add any comment. I stand by my professional opinion.

I've only

had to defend a survey in court (jury trial) once. Just be honest, if you don't know an answer just say so. If you try to bluff the other side will catch it. Don't volunteer infromation, wait for your attorney to ask. I'm assuming you did all the proper research and that your field procedures were correct. If so then you should be on good solid ground.
