Richard, I wonder if this is from the conference at which you gave a presentation. Did the conference organizers report paying you an honorarium and send you a Form 1099? That is probably what kicked the collection procedures off, if so. The money was reported as income to you and so got into the system in that way. I'll bet that a letter explaining that you are a full-time resident of Oz and that the purpose of the money was to compensate you for travel expenses would close that file.

If You Want to Clear It Up......

...don't wait.

Uncle Sam loves to pile on the interest and the penalties, and when the collectors see those big numbers, they hate to let go.

If You Want to Clear It Up......

BTW here is a link to the forms and other information that you'll probably want to take a look at. I doubt you'll have any tax liability. The instructions for Form 1040 discuss all sorts of things, including non-resident alien (don't take offense, they mean "Australian visitor") income.

THE USA ARE CHASING ME FOR A 2005 TAX RETURN ...KENT..

Kent, the letter said respond with enclosed self addressed envelope.

..... Obviously been removed to avoid paying postage.

Form number 1040.. US.Individual income tax return.

Form wants me to sign under signature and title of tax payer.

Quaintly Under enclosures says Envelope and "copy of this letter" I thought I had received the original.

No where on web site you can email any one.

No telephone codes to ring......

Shall send back a response by snail mail as U said.

Just out of curiosity, Richard, roughly how much did the conference organizers pay you that they reported as income? You may have to file a Form 1040 Schedule C to show that it didn't cover your expenses and that in fact your "seminar business" had a loss in 2005 and so no tax is due.

No Tax I.D. Number

The other wrinkle to this is that you most likely don't have a US Social Security number or other taxpayer i.d. number. So I have to wonder how the honorarium (I'm still just guessing that's what your US "income" for 2005 is) was reported.

Form 1040 NR

Okay, it looks as if you are at most obliged to file a tax return as a non-resident alien (that's IRS for "Australian visitor"). That would be a Form 1040 NR or Form 1040 NR-EZ.

Teachers are exempt

From reading the instructions for the 2005 Form 1040-NR, it looks as if you would be considered a non-resident alien for tax purposes.

However, be sure to mention that the purpose of your visit to the US was to teach a seminar. Teachers appear to be considered exempt and it is in fact a fair description of your conference activities. No need to mention all the ale tasting, eh?

Class of visa

Oops, but it depends upon the class of your visa. The exemption is linked to only certain classes.

What authority does the IRS have non-resident aliens in a situation as this?

Sir Veysalot

I doubt they would do anything while RADU is in Australia but if in fact this is a valid request then they might dink with him the next time he wants to visit. Sorta like an old warrant that shows up when you try to enter the country.

Seems like a silly thing but that is the IRS. Once something clicks in their machine then it's not likely to go away on it's own.

Deral

My question would be did the ACSM give RADU a 1099 or other form for whatever type of compensation that he might have received? That is the only way that I see for the IRS to have even opened up a case on this.

You should have just came here illegally, then you wouldn't have to worry about those pesky taxes.

Would not worry to much about it, the one in charge of tax collection and enforcing those laws, is a tax evader himself it seems.

Running on Empty?

Running on empty...now that's an understatement. You've got to look at the group that has their hands on the purse strings and understand how much they love taxes. They want to spend us into oblivion just to raise our taxes to pay for it.

One day, hopefully this November, there will be a lot of democrat voters who finally realize you just can't put democrats at the federal level and expect any good to come of it.
