Maybe they had one of those "pay when paid" clauses in their contract and surveyor never got paid.

That made me laugh as the only two parties I have had to sue for payment in 15 years were an engineering firm and a attorney. Got paid for both.
Like Bow-tie said above they wanted to pay me we they got paid. NOT
