I??ve been following this story for years. Long and short is a developer dammed Campbell Creek, a navigable water way, (I??ve floated it), in the 50??s and created this lake which has evolved into a very exclusive neighborhood. The State and Muni both agree the lake is public, the residents have said for years it??s private and harass anyone attempting to use it. The primary public access is a section line easement 66?? in width, with a home built squarely in it with an owner who denies its existence. It??s been surveyed but any stakes disappear and wire fences pop up to hinder access. Fun stuff.
Had a similar situation in NY there was a clearly defined public access to the lake. One of the owners would tie his big mean dog with enough reach to get into the access. Don't know if anyone ever got bit and sued him.
On a side note to that, our Utilities Engineer when I was at the AK DOT was out in the ROW and the same thing, guy let hos dog have enough rope to get out there, our guy got bit and when he said something to the owner, he was met with indifference. We told him he should have called the authorities, but it was one of those small towns in SE AK where everyone knows everyone else's business and the cops are their neighbors.
