Asked my client (bank) for copy of the Title Work.
This is the description page from said title.
Made me laugh.
Not sure but two things come to mind:
1) isn't it "registrar of deeds" not "register"?
2) don't lawyers write the legal descriptions and surveyors write the property descriptions?
E
In my neck of the woods, it is Register of Deeds. Others may differ.
In my neck of the woods, new descriptions are to be written by land surveyors. However, that hasn't stopped anyone yet, except in rare cases.
The holder of the public office of the Register of Deeds is probably properly referred to as the registrar. But I believe that the term is probably making reference to the deed registry rather than the individual who holds the public office.
When writing legal descriptions in my former life, I always referred to instruments as being of record in the office of the Register of Deeds, XXX county, etc.
well, we know what late poster from MI would have liked that. 😉
When they run for office the signs read "Elect Fran Tarkenton for Register of Deeds". Safe as for Sheriff or County Clerk or County Treasurer.
Title companies are not in the land description business, they are involved with title. See nothing wrong with what you received if you asked for a description. Now you can get busy and research the deed documents. Could be a description that describes the parent tract and excepts out everything but the the tract of interest, the remainder.
