Although ROE does apply in most cases, it does not excuse the surveyor from his/her responsibility to notifying the property owner of the need to enter and survey said property. Paying the proper respect to the adjacent land owner will usually be rewarded with permission to complete your task instead of having to involve the legal system. I may be mistaken, but my thoughts are that ROE is intended to protect the Land Surveyor, not bypass others property rights.

Does Florida have any LIDAR data available? If so, just match up the datums from your site to the Lidar and then hand the engineer more data than he'd ever need...
