Who has had success in getting easements removed from a PTR after reviewing the deed that grants the easement?
I received the underlying docs for two easements yesterday and spoke with an Advisory Title Officer (ATO). He agreed that one of the easements listed should not have been in the PTR.
One down, one to go.
The second one may get removed. I emailed him a PDF of the survey late yesterday so he could take a look at where the public utility hookups were and also where the power poles were in relationship to the properties. Both pole bases were in the RW of the alley at the rear of the lots. It's a wide alley ( 24 feet ) that has a flare on the west side so that the width gets wider as one would move south from the properties, so access to maintain the poles from the lots is not needed.
The City of Los Angeles is now the one who handles water, power and sewer hookups. Gas is So Cal Gas co. and is located on the main frontage. The lots go from main frontage to alley in depth.
Easement Two Reservation
Here are a few of my observations about the reservation and comments to the ATO.
1. The reservation is in favor of the grantor, and assigns.
2. The corporation grantor, Palisades Corporation, no longer exists.
3. Palisades may never have assigned the reservation to the City of Los Angeles.
4. The only utility in the alley is for power drops from the poles within the alley.
5. Service of the poles is from the alley.
6. The garage of the property directly south of my lot was permitted to be 2 feet from the alley R/W.
7. The City of Los Angeles does not show an easement for public utilities in the area that the reservation covers.
Hopefully, he'll get this off the PTR and insure over it. He gave indications that he may do so but wanted to see the survey first.
I'll find out in a few hours if it's yes or no.
PS If Palisades had assigned the reservation to the city, one would think that a document showing as much would appear in the public records and that would appear on the PTR.
