what's your take on plats that are recorded with no deed afterwords to reference the plat. I have run in to this 2 times in the last month. Does the plat legally combine or subdivide the property . Tax department did not recognize either of the plats . Plats were also found by chance .
Maybe, maybe not. Probably depends on state and/or local regulations.
In Virginia there are such things known as "owners consent" that include notarized signatures that may let a plat be recorded stand alone without a deed. But their acceptance varies from county to county based on local subdivision regulations.
Different places and different practices. Here a survey plat is almost never attached in any fashion to a deed, easement or anything else similar. They are separate recordable entities.
In my area of practice, Southeast Pennsylvania, the recording of a subdivision plan
itself does not create new parcels until the first deed from that plan is recorded.
But that could be any deed, a lot, right of way , easement etc..
Yes, the plat legally subdivides the property in NC. No deed needs to be filed.
Its worth mentioning that the Tax dept doesn't need to create separate tax ids until a portion is sold to a third party or an owner requests a tax id. Often the owner doesn't do that because his tax may be increased if he has additional buildable lots.
