Was just looking at a description in preparation of drawing it in CAD when I encountered the final paragraph:

"AND EXCEPTING THEREFROM ANY PORTION OF PARCELS 1 AND 2 ALREADY PREVIOUSLY CONVEYED."

This should be fun!!

That is like a surveyors note on a plat that states "Encroachments, if any, are not shown."

I have seen that many times in deeds to land that had not been surveyed in a long time and the tracts that were sold were probably stepped off by the owner and buyer.
Several times the client would say that there was not any of the family left that the land was sold to and ask if it was theirs now............not for me to say.
And people still try to believe that every survey can be made for $300......
What is true is that most any deed can be made and filed for recording at that amount.

That is exactly why they hired a surveyor, now then, who hired the surveyor?

The present land owner, the prospective purchaser or the title company?

I have done this from time to time for a title company, they want to know what the description looks like to compare it to the record, tax, adjoiners etc. There are times you are happy that no requests actually come back to survey same, or a very lucrative job could develop. With any luck the description includes a Parcel 1 and 2, with some semblance of reality. This is the main reason to do suitable research before actually quoting such a job and/or time frame. Of course you already knew that and this was just a Friday evening musing.
