I am thinking more in terms of Karl Marx. I do not question that the Government must sometimes restrict the rights of the individuals to foster the public welfare. However, the individual should be justly compensated by the public. If the restrictions are on the land before an individual acquires it, they should be subject to the restrictions. The issue is when someone purchases the land with the understanding that they will be able to use the land in a certain way and then the land is restricted by an agency or municipality without any consideration for the economic or personal impact to the property owner. In this case, this regulation was impacting a property owner from passing on part of his property to his son. Who decided that 40 acres was the magic number for a tract within the watershed? Was this based on a grant study by the Institute of Fuzzy Math or a bureaucrat's decree? These types of action undermine our individual rights. Of course, this is from someone who believes that the sole purpose of government is to protect the Life, Liberty and Pursuit of Happiness (Property) of the individual.

My fights with city hall or county government is done in a public forum. I and my client can always get variances to the ordinances/resolutions the morons come up with by defining the restrictions of the peaceable enjoyment of ones property. I am not a popular person in my area when it comes to dealing with the government. I typically provide my time to my client for the fights on my own dime because I am out to protect the health, safety and welfare of the public as well as future generations. It also gets me good references for other property owners who have been restricted by their local governing authority.
