CONSTRUCTION DEAL

Hello!

I've been getting emails from a company called Construction Deal. They want me to get on their bid list.

Has anybody heard of them or dealt personally with them?

I tried it once for a year. People looking for contractors, plumbers, laborers, etc., sign in and if they are in your area and you are on the list, you will get an email. You can then contact them directly or not. Generally they will take calls from 5 to 10 other surveyors before selecting. It's a race to the bottom and with a one year try out I only got one job out of it. It used to be $20 per month, but now it costs something like $20 per lead sent to you and an annual fee, with no guarantee of getting the work.

I don't believe it is illegal, as they are just putting you in touch with people needing a survey done, but the people looking on there are looking for a "deal" as it says in the name. I found it to be a race to the bottom price site personally and I didn't participate in that at all. The job I got, I was the first to reply and the client liked me from my first impression over the phone and my willingness to meet him at his property.

In Ohio the monthly/yearly fee for the equivalent of placing an add would likely be legal. However, the fee per lead would likely run afoul of the following administrative rule from Code of Ethics for Engineers and Surveyors: 4733-35-06 Solicitation of employment.

(A) The engineer or surveyor shall not pay, solicit nor offer, directly or indirectly, any bribe or commission for professional employment with the exception of payment of the usual commission for securing salaried positions through licensed employment agencies.

I don't know where that language first originated (apparently many states have codified something similar), but it is a classic example of pi$$ poor regulatory writing. Since “employ” has multiple, and somewhat contradictory definitions, meaning both to engage the services of and to provide a job that pays a salary, I would think that anyone who was being reprimanded based on that regulation could successfully argue that it is vague to the point of being unenforceable.

Just in general, why would you want to be on an internet based construction job "bid list"? That is a race to the bottom. If you are going to have to bid on construction staking at least let it be with people you know and who know you.

I dont want to be on their list! I Just starting getting an email from them everyday.

It sounded like a scam to me.
