In the latest POB, in the "Unmistakable Marks" column by Kristopher M. Kline PLS, he writes an article entitled "Just a Mere Survey?".
Interesting article, but I think he is coming away with wrong take on the court rulings he cites. He seems to be saying that the courts just don't have much respect for land surveyors' opinions.
But the more interesting cites (towards the end of the piece) seem to be about surveyor's opinions that would end up screwing up the property lines from where they have already been settled.
So my take is that the courts do have respect for surveyors' opinions, except when they try to unsettle a neighborhood, and rightly so.
Courts know that our opinions are not binding like theirs are, but Cooley said we should use the same lights to guide our decisions as courts do, and they don't like throwing neighborhoods into disarray, and those surveyors who do are ones who "don't get no respect".
That's the same take I had on the article and cited cases.
