She tore down the neighbor's brick wall based on my survey which clearly shows the brick wall is on the neighbor's property. The offense is a felony because the damages are greater than $1500 and less than $20,000. Not only does my survey not show an encroachment, I never verbally told her that the wall was on her property. I think it was a vindictive thing to do because the original disagreement was for the fence in the back yard and the wall that was removed was in the front yard. I specifically told the client that her neighbor's fence was well within her property. The sheriff's deputy come looking for me to give a statement on the whole situation. If they publish a report, I will link to it here.

No, I think if it is gone to the Sheriff's department, it will be a matter of public record. I may not include all the details or my opinions about specific stuff but now that an investigation of a possible crime has commenced, I think I can state the facts.

He's only stating facts, of which he will be making a report saying the same.
Now, if he has stated opinions as to her character and mental stability, or lack thereof... Then that's something that could become an issue later.

I did inform the deputy that I was qualified to give a professional opinion on boundary locations but I am not qualified to state professional opinions on mental health.

Maybe I am paranoid, but in most cases, upon reflection, almost everyone wishes that they stated something a little differently in the record than they did. Even the answers to the Deputy could hurt you somehow in the future. Call me crazy, but I wouldn't answer any questions without advice of competent counsel and I would not discuss the situation on the Internet.

But the sheriff's deputy does. I probably should have taken some when I was out there, but I didn't. The graffiti painted on one of the wingwalls in dayglo orange is a little odd to see.
Giving the statement was interesting in that it gave me a taste of giving testimony (or it seemed like it). I'm sure it's nothing like having adverse or hostile counsel peppering you with questions.

As I recall, at no time have you put forth the name of any party involved in this dispute other than your name and your company's name.
Ergo no grounds for Libel. Nor have you given a specific enough location so that someone (such as me and I surveyed in that area for 3 years) could go looking through the county data base and actually determine the other parties involved.
I don't think you have posted anything to worry about, yet. Remember the YET.

Thanks Stephen. I consider what I am saying in my posts and have withheld a lot of details for that very reason. However, I feel that now that many of the facts are now on public record due to the involvement of the Midland County Sheriff's Office, I am saying nothing that is not already in the report. I hear and understand Merlin's cautions, but the facts are the facts. At the point that I do get a copy of the report and/or any other public records, I will still redact the names/addresses of the parties if I post it here.

Actually it could not. The triple dots mean it is edited texts. So if a lawyer says did you not say and he says no he did not and then the lawyer says I have this quote, he says can we have the full quote, the dots mean you edited. When the full quote comes out, the lawyer is shown to have lied and that blows his sides credibility completely. If he refuses to show the complete quote, then he cannot prove that the quote is real as again Andy has disavowed ever saying it.
