for refrence the link below is post i am refering to:

I would like to revisit this topic from a slightly different perspective.
I found the question to be poor because there was a great deal of questions that I have before I could make a decision.
It appeared that most didn’t like the question but would choose to hold the pipe (an option not listed)
I have the following questions:
Simultaneously conveyed property
Assuming all centerline and plat boundary monuments are perfect (something that would never happen) and the fence lines are in agreement with the found lot corners.
1) Would you hold a corner .2’N,.2’E in a subdivision platted 2 years ago(typical lot 50’x120’)?
2) Would you hold a corner .2’N,.2’E in a subdivision platted 8 years ago(typical lot 50’x120’)?
3) Would you hold a corner .2’N,.2’E in a subdivision platted 15 years ago(typical lot 50’x120’)?
In situation 1- I would not hold the lot corner. How I would monument it and map it would be dependent on what the survey was for. EX: Sale of the home I would show the found corner as .2N,.2E. If it was for the construction of a fence, I would set it at the calc position.
In situation 2 & 3- It would have to be a pretty unique situation for me to have a different answer than situation 1.
I look forward to your thoughts! Feel free to blast away!
Charlie
If the corners are original to the subdivision and do not conflict with adjoiners property then they are the corners. No question. The monument marking the corner has no "error". The bearings and distance that reference it may.
I should have stated it is a original monument.
I would take the fact that it is close that it was intended to be set at the calc corner. It had been hit, within tolerance at the time it was set etc. I think the property would stay at 50x120.
Thanks MightyMoe
Also these are lot corners
Charlie,
In all three scenarios the lot corners as found are the lot corners as they are. You hold found and you show it as ACTUAL and you also show RECORD but with smaller and lighter-weight lettering.
Why would you want to deviate from our most basic legal mandate in such a simple and straightforward scenario?
Stephen
If the monument has been disturbed then that gives you an opportunity to rehabilitate it.
But an undisturbed original monument has no error. If the lot line ends measuring 49.8 or 50.2: then so be it.
