Recording a plat of existing lot (lot of record)

Yeah I called Tom Morgan and he agreed with me. However he said that because he does not have a law degree attached to his name the planners more than likely would not listen.

I think my next move is a consultation with the county attorney and then the attorney generals office.

Like I said its a matter of principal at this point. If I have to follow the law while surveying then planner and registrars should do the same.

Call the board of registration, they have an Attorney. If they can call you on the carpet for a screw up on your part surely they can get their Attorney to get in touch with the County Attorney and get the Register of Deeds and their planning department straight. The board should be there to help you when you need help.

I would skip the county attorney and go straight for an advisory letter from the State Attorney General. That way you could solve this problem for good for all of us..Let us know what happens whatever you do.

And here I thought North Carolina was a progressive State with reasonable people handling normal things in a reasonable manner. Obviously not!

We can file any survey we do. In the very rare case where someone gets their panties in a wad, we can simply file it as a miscellaneous document. Virtually anything can be filed as a miscellaneous document, so long as it is not pornographic or some such other vile thing. People do this all the time with common things. You can record a copy of a cash register receipt proving you bought three candy bars and bag of chips if you are willing to pay the $8 filing fee.
