You bet they have a franchise agreement, but not -- as Paul suggests -- because the cable companies require it. It's the local agencies that require it; if they didn't, the cable companies would be happy not to have to jump through the hoops. Local agencies are able to require franchises in exchange for the right to use (and tear up) the public rights-of-way.
