And why do they keep asking for successors and assigns? Does anyone do that...especially since the certification is clearly spelled out?
Funny I had a request this morning that included their ALTA requirements, which are from the 2011 standard. And you guessed it, they want it certified to everyone's successors & assigns.
I had one a while back argue with me when I said I wouldn't do some of the things they were asking for, saying "I've never had a surveyor complain about any of these". I said "You know there aren't that many of us right? You realize we all go to the same conferences and chapter meetings right? You know we all complain about you on the same online forums right?" After a bit of a pause "No I guess I didn't know that".
Had an attorney give a talk to our PLSO chapter several years ago. He said that the usual practice for most attorneys, especially those that aren't doing real estate every day, is to consult their old files and request whatever was requested the last time such a job came up.?ÿ Including requested Table A items. Know that and negotiate.
