I'm working on a project that's likely to rely on?ÿErnie v. Trinity Lutheran Church in defending an established line.?ÿ Ernie is a seminal case in California, and in reviewing the opinion I got to wondering what the actual site looked like.?ÿ The case is set in San Rafael and was decided in 1959, so things have changed a bit, but it appears that the basic structures are still standing.
In the first photo, Jessie Ernie's house is on the left, and Trinity Lutheran Church is on the right.?ÿ (Both properties are now under different ownership, and the church is now a performing arts center.)
?ÿ
Below is an aerial view with the (very rough) parcel lines sketched in.?ÿ The aerial is pretty distorted, so the improvements don't fit the parcel lines well.
?ÿ
David Karoly has done quite a bit of research on that case and the survey.
Re-read the opinion after many years. Thanks...
