I would never do something like this without consulting the owners to come up with a solution that best fits everyone's interests and then have the deed changed. The ditch makes good dividing line. But, if I had to come up with a scenario without contacting owners I would -

First survey the entire perimeter of Lot 39 to figure out how much acreage is actually there. I like straight lines, so I would run a line parallel with the west line of the section from the north line of Lot 39 to the south line of Lot 39. The location of this line would be determined by dividing the entire acreage in half so the same amount of acreage is on each side of the north-south line. Perhaps on Monday, if I have time, I will do this mathematically based upon record or plat distances.

So I guess I sort of got it right. I just didn't specify which side line to run it parallel to.

My solution, if I had to come up with one, would be to completely survey the perimeter of Lot 39 to figure out the entire acreage. Based upon plat distances, I came up with 75.708632 acres total. Divide this by two and I get 37.854316 acres (1648934.007 sq. feet).

I then made a random line (parallel with the west line of the section) where I thought the half acreage would be approximately located. I then calculate the area for the east half based upon the random line. I came up with 1621315.6846 square feet or 27618.323 square feet too little.

The length of the random line is 1357.0058 feet. Divide 27618.323 by 1357.0058 = 20.3524. I move the random line 20.3524 to the west. Recalcuate the acreage and come up with 2.747 square feet too little for east half. Repeat same process and move random line 0.002024 feet to the west. Recheck acreage for both sides and come up with the same. (Plus or minus). Location of line shown in magenta.
