I don't see anything about a 1834 Land act, but instead the Act of Feb 1805 which set the c4 as the BB intersect. But, I did find the information on Mr Justin Butterfield and his un-authorized instructions of 1849-1851.
Here is a nice pdf discussing this very issue:
If it can be shown that during some years that these instructions were followed, and that the corner was set by them, it may be the legal c4.
