True, but they wouldn't have to. The function would still be the same as for encroachments - we may not have the authority to define them as such, but finding evidence of a possible encroachment, cemetery, prescriptive easement, etc. could have avoided a problem by alerting the buyer and title company to possible property rights of other parties.

 

The ordinance might still be an issue, though...
