This one is rough. I reviewed it with a flood plain manager who has to look into it...
1. Is this a window well or lowest adjacent grade?
The grade by the building is 2.5' below the new BFE. The grade between the water and the 'window well with a pool' is 1.4' above the new BFE.
2. We permitted this structure before the maps changed. We went through the CLOMR-F process to allow for the basement, with utilities and etc. It was an A zone. The client did not believe it was necessary to complete the LOMR-F.
The fill was placed a few months after the aerial lidar flyover that was used for the new maps. The new maps call for the house to be within the V zone.
Elevation cert completed calling the low point as a window well, but I did document this in the notes as it is not a typical window well. Our plan had been to fill all around the house and the client made one of many field adjustments including this peach.
I placed a call into the local scientific firm that has been remapping the flood zones / filing appeals. I am confident in remapping an A zone; a V zone is a little trickier.
Any thoughts?
Is The Basement Area Habitable?
If not, one could actually make waterproof window wells and not be concerned about the pool area. Still is the lowest adjacent grade.
If the basement is habitable those windows are inadequate.
Does the fill around the pool meet the requirements of a dam?
I take it the owner did not get a COE Net Fill Permit.
This would require a very large retainer and no promise of success.

Basement is partially finished. Utilities are in the basement as well. It was a site alteration made by the client during construction. There is actually sealant on the concrete between the windows (looks bad).
Nothing special was done with the fill around the pool, some of it is natural grade. I would have to review to see if it counts as a dam. If it qualifies, it was not necessarily intentional.
The fill was not placed in wetlands with a Coastal Flood Zone. How would a COE net fill permit be required?
Flood insurance quote came back at $40k. Hopefully there is a solution for the guy.
