Exception Larger Than Parent Parcel

I am surveying what is left after removing the exception from the original parcel. I am not worried as it is about 1.4 acres remainder. Original description closure error, 12'. Exception description closure error, 0.7'. I have the Filed Map Subdivision of the exception which closes. Subdivision is under construction and any missing monuments have not yet been set. The exception description included access to a second State Highway from a different parcel, far away from my PQ. That subdivision includes the PQ South and West boundaries. I also have 2 Filed Maps for the adjacent Parcels to the North.

Interesting on my PQ, the landowner pointed out the general location of a common corner with the Filed Map Parcel, being on the other side of a board fence. The good side of the fence faced to the North, so I asked you built the fence? "No the adjacent owner to the North built it so he did not have to look at the barn. I had never encountered a fence built by an owner on an adjacent parcel, but hey, every one is happy. Main purpose for the survey is to built a dog fence along the perimeter. The last time the dog wandered into the State Highway included $3,000 in veterinarian bills.

Unusual to me is the larger size exception and the adjacent owner built fence.

I recovered adjacent surveyors pin/cap just North of the fence. Adjacent surveyor sent me SPC of the 3 common corners and 3 on site GPS points. PQ owner wants me to set missing corners, but I may defer that to the subdividing surveyor. I plan to GPS those points and at least 1 adjacent map to the North corner. By virtue of the exception the Filed Map Subdivision is Senior. The remaining Common Corner will not be set without complete agreement between the surveyors.Third point is on sideline and some research is needed regarding the highway ROW width. Filed Map calls for 40' from CL, my PQ may be 16.5', 20', 25', 30' or 33'.

Comments requested on the setting of missing corners, by myself or deferring to subdividing surveyor.

Yes, set a big concrete monument with a brass cap to protect your client's rights from the developer.

That is not a problem. I would set it exactly where the developer's surveyor would set it.

The developer's calls control and the developer's surveyor has held record angle and distance.

I would have to find some kind of gross negligent error to do otherwise.

Regardless, it should be done in collusion. So that if you set them, or he sets them, they wind up in the same place. (Can you say sing from the same piece of music?). I don't think it matters who sets them. I have had experiences where the "Other surveyor" was older, and short handed, and could not get things done well. He thanked me for setting them, and telling him where they were. It made my world easier, because he came along later, and flagged them, and called them "The corners".
