Taxes in Texas
Posted by luke-mcchain on April 18, 2024 at 8:56 amWe have to charge taxes on surveys in Texas (anything referencing a property line). Would this hold true for a Texas firm providing surveys in other states which do not require taxes?

In NJ we do not charge taxes on surveys, we provide professional services, not a product.

Same as Chris here in California. The lawyers would never allow taxes on services.

Yes, you have to collect taxes. Even in states where it’s not collected.

Not true in NJ. When I first started my LLC in NJ the state tried to fine me for not paying estimated quarterly sales taxes. It took hours on the telephone but I won because a professional services business is not required to collect sales taxes in NJ, just as you don’t pay sales taxes to lawyers, doctors or dentists.

Some quick googling (so take this advice with a grain of salt) shows that taxable services that are “used” outside the state are not subject to Texas sales tax.
What I find funny is that surveying is lumped I with janitorial services and lawn care.
