Equipment Purchase
Good afternoon I have a used resale equipment company in Portugal and recently had a bad experience. I bought 4 total Leica stations as new “unused” ones to a company in the USA and received the equipment with several signs of use which made it impossible for me to resell them to my client. Does anybody know me to indicate some legal support or mediation to solve the problem? Besides having to recover the equipment money, I need to recover the money spent on transport and taxes. You’re in a tough spot. Buying expensive equipment sight unseen from a seller of unverified reliability is risky enough when you’re in the same country, but when you’re across an ocean it’s even more difficult to recover on a sale gone bad. If you went through eBay or PayPal you have some relatively simple avenues available for pressing your claim, but with an individual-to-individual transaction I think you’re stuck with the civil court system, and trying to navigate that long-distance may not be practical (it’s bad enough when you can manage it in person). It doesn’t sound like a case of outright fraud, at least not on the scale that would interest the local District Attorney, so a criminal complaint probably isn’t in the cards. You may have to chalk this up to lessons learned and walk away.

Thanks for the comment . It was from company to company with invoice. I already bought other equipment from the company in question and it went well. Not this time .

Many questions come the way of surveyors. Many times the answer is, “You need a lawyer.”
This is civil. You have to lawyer up.
That being said, there might be avenues that you can follow in your own country. For instance if someone in your state department or commerce department complained to their counterpart, it might move something. But it seems unlikely.

Unfortunately, and after the seller’s promise to return some of the money, I’m still waiting. I’ll wait another few days. If do not return, I’ll write who it is. I will also legally settle with a United States lawyer who has been appointed by a friend.

IMHO be wary of naming them, particularly if you are going legal and that process is not yet concluded.

as much as I would like to find out who is it, if you are going to lawyer up, I would suggest you do not name and shame yet, it could be held against you. Seek your lawyer’s advice first before your next move.
Do not shoot yourself in the foot in the heat of the moment.
