To restate my request, what law elevates the plat over notes? I contend it is a matter of evidence rather than statute. The answer will be determined by the fact pattern.
Even where no evidence exists on the ground, the record contains at least three sets of data, probably more. Complete research and proper application of statutory and case law are better tools than ‘general rules’ developed without legal foundation. The plat and notes remain ‘unranked’ for good reason. They are on equal footing until the evidence is developed showing otherwise…
