In a Supreme Court of Virginia decision published last Thursday which can be found here:

I was cited in a foot note as an authority! How about that!!!!

Of course this is the same Supreme Court that the last time they mentioned my name they accused me of "confusing the jury" and overturned the original jury decision. So we went back and won the case again!

I will also comment that I find it surprising that any court (never mind a state supreme court) would use as a citation something they find on the web.

Recognition is nice, but since your recognition is in a court case, you also get a small sense of immortality! :good:

Congratulations !!

I too, had to rub my eyes when for some reason I must have been on the right wave length for the judge when, on a drainage case, he referred to how I reacted to the new Rules of Civil Procedure being that the 'expert' must present her/his evidence as if she/he was an unbiased person.


[21] Derek Graham also signed a similar acknowledgement, and both by his demeanour and his evidence, it was clear that he takes it seriously. He is an experienced Ontario Land Surveyor who completed surveys of the lots in question with a particular emphasis on grading and his surveys are found at Tabs 6 and 7 of Exhibit #2. His evidence was very useful and not seriously challenged, and I have not the slightest reason to doubt either his credibility or his reliability, nor indeed, his expertise in his chosen field.
