Wisconsin Supreme Court settles ... uh what?

The court is done, opinion given. There isn't anything else to do other than recognize Henn Road as the boundary. Why do you think they need to mess with the title records? Record the judgement and go forth accordingly.

There is not much more I can say, can't believe I've posted this many times already. Got other things I need to do. Carry on.

The saving grace in this lone Wisconsin case is that it looks as if all of the adjoining owners (or their predecessors in title) with an immediate interest in the section corner alleged to be upon the centerline of Henn Road have been in some fashion parties to the extended legal proceedings, beginning in the early 20th century.

Furthermore, where the Wisconsin court had room to maneuver is that there was so little surveying evidence before them that might have otherwise shown that the lines of the government subdivision lay elsewhere.

On the contrary, I believe the court ruled that the section line is the road. INtent is determined as of the time of the conveyance. So other parcels in the affected sections would need a seperate analysis, including whether they were conveyed in reference to the original section line (road) or in reference to the incorrect 1912 determination (whether struck down by the court or not).
