GLO intent is everything when it comes to "fractional" quarter sections.?ÿ I have read the KS Supreme Court case but I must have missed the reference to the California case.?ÿ I have divided several of these quarters into even aliquot parts.?ÿ Depending on whether it was long or short, one party got the "E?« SW?¬ and part of Lots 3 & 4" or "All of Lots 3 & 4 and part of the E?«SW?¬". In my opinion, it doesn't really matter if the patent, for the example, reads "All of the SW?¬" or "Lots 3 & 4 and the E?«SW?¬", patents reference the government survey and every part of the Township/Range plat is a simultaneous conveyance, of which the approved plat is the official results of the survey and has the dividing lines and acreages which clearly show intent.
