The county map shows an old county road heading west from a state highway. The actual creation document created a road centerline 150' north and parallel with a section line while the physical road has a access almost 50' south of the road description. In this part of the world the physical location trumps the described path. The road was never formally constructed and a two track goes west from the highway through a pasture type of barbed wire gate.?ÿ
Anyway, the GIS shows a strip for the roadway considerably narrower than a 60' wide strip adjacent to a parcel of land north of the strip shown, the map then shows a parcel south of the strip, the strip was shown blank for ownership. Being a county road it's an easement and doesn't have any fee title associated with the public, only an easement for road purposes. So the person owning the north parcel petitions to vacate the road and gets it done, now because of the GIS map he believes he can shift his property line to the center of the strip to the south.
Even the powers that be think he can.

The south line of his deed is 120' north of the south line of the section and was intended way back to be the south line of the Co. Rd. The neighbor to the south's north line is described 120' north of the south line of the section and nothing at all changes with the vacation. The north owner was getting ready to build south of his south like into the newly "vacated county road" assuming he now gets 1/2 of the road. Not only that but he thought he got land to the west since the GIS shows the county road widen to it's full 60 feet after passing his west line. The subdivision he is in terminates on his west line and later a different subdivision filled in that area.?ÿ
The firm involved with all this called me to look at since we have corners in the area and I'm having a jaw dropping moment this morning.?ÿ
