The Empire State building survived a collision from a B-25, so it probably thought the drone was just a pigeon.
Sure come an get it ... meanwhile have the police waiting.

Well, I will admit that flying that thing low over city streets would avoid avoid potential contact with a plane but, still, that's a rather narrow flight path for the operator to keep in sight constantly. Next thing you know some window washer will file a workmen's comp claim after getting hit by one.
That was a perfect opportunity for the news to describe the required FAA registration. Google Earth shows the Midtown Skyport about 1 nautical mile from the Empire State Building. That would be well within the 5 nautical mile range requiring notification prior to a flight. I have to assume this fellow did not announce his air presence.
