Individuals have always been allowed mediate or arbitrate their civil disputes. All these laws did was formalize the process so that the court could require parties to go to arbitration or mediation before going to court. Most good attorneys would recommend some kind of negotiation before court anyway.
Your right that surveyors are in a very good position to mediate boundary disputes.

I was curious as to what you were referring to; "In the mid '70's, the federal gov't passed an alternate dispute resolution law,. . ."
I am well aware of the fact that before the trial starts, the Judge will ask both sides if they cannot negotiate the outcome. If not, the trial will start.
At least I have experienced that.
I assumed the citation would be readily available, like your other favorite statements.
