Title Lines again
This is a bit off topic from the other discussions about title. Some decades ago I attended a seminar where the presenter was discussing title lines along a long easement project for a community wide water project. By that time I'd spent a significant portion of the prior ten years doing exactly that and many more private utility easement projects.
The presenter explained how each property crossed was researched back to creation and all the title issues that were turned up, and the effort used to fix them. I was taken aback, after many years doing it, that's not how the lawyers, title people, or communities treated title issues for the easement projects I worked on.
Now years later I'm even more experienced, I can say "It's not that kind of survey".
Please clarify what "community wide" means. The first thing that pops into my mind with those words being used is that some sort of governmental agency was involved.
I will admit that when it comes to water right issues, I am completely in the dark in the dark on the subject as we don't deal with those things on the east coast.
If I remember correctly, it was a city-wide water system upgrade from a new source outside the city and crossing a number of properties to get it to the city limits.
As far as water rights, that's a whole nuther matter.
If that's the case, it's different from what we have discussed in the prior threads relating to title lines because of the argument for the public benefit. Different doctrines could likely come into play.
