Thinking ahead
So I have this survey. A family of 4 brothers and their mother ended up owning a number of adjoining blocks in a 1902 subdivision. One son living on the southeast corner of the cluster of blocks talked mom into joining him to vacate the block he is in, the half block to the west, the street between the two blocks and the alley running through his block. Now the half block, street and full block are owned in three parts. The son, his ex wife and mom. Mom passes and the estate is to be divided up between the 4 boys. The one living on the vacated tracts gets all of it except for land the size of two of the former lots and the ex wife’s parcel.
So I go out and stake it to the plan I was given, the son living on the vacated land doesn’t like it. He wants me to move the pins because; “It doesn’t fit into his plan”.
I ask what plan is that?
He says he wants to break up the parcel and sell it,,,,,,,,subdivide it.
Subdivide it?
A few years ago he went through the vacation process, eliminating roads that match up with existing roads, alleys that served the lots, small lots that you could combine any way you want to and were grandfathered from the more restrictive regulations of today.
He has no idea what he would go through to subdivide that parcel into usable lots now, all the cost of paving roads, sidewalks, storm sewer, and on and on.
His brother just sadly shook his head when I brought it up.
My advise to all my clients is that unless there is some tax issue keep land split up as much as possible.
