Fine How Do You Do
I just finished a survey where four other surveyors had performed work prior to mine. I found several monuments called for in their descriptions. Their distances and mine fit perfectly. I had to replace a missing property corner on the tract I was partitioning from, and I put it perfectly in line with the recovered monuments that were called for in three different surveyor’s descriptions. It was one of those jobs that goes so well you wonder why.
I just got off the phone with the neighbor to the north. This lady’s tract was surveyed by one of the aforementioned surveyors. My measurements were exactly the same as his down to .00 of a foot. She is terribly upset and explains to me that my pin is wrong, because she was told by her “title man” that her line went into my clients driveway. I calmly explained to her the work we performed and the total agreement of her deed and the deeds of the surrounding tracts. She then says, “Well I don’t ever go by what the surveyor says or by the pins they set. I listen to the people who tell me where my line is and I am about to lose it on you…”
Isn’t that a fine how do you do?

It doesn’t sound like there will be any convincing her otherwise.Is there an encroachment? She wants to argue about something, and you happen to be there.
No encroachment or problem of any kind according to the deeds of record and monuments recovered. She just wants to own her neighbors driveway. She wants there to be a problem. We’ve all had these kind of neighbors to deal with, haven’t we?
we have a trespass law with due notice
when we foresee issues, we send a certified letter to the neighbor providing the notice.a few months ago, we sent one out. the neighbor, who was known as a witch, came into my office to tear me a new one. she apparently had to leave work early to get the certified letter and did not know why a survey was needed.
later we found her driveway to be a couple tenths over and significant cutting over the line. we set a nail or two in the pavement and set 12″ spikes next to every witness stake. we put them down low so someone cannot see them when they rip out the witness… the witch did rip out the stakes and we found all of the spikes.

LOL. That’s good stuff there. Oxymoronic?
It is great logic to go by, I never listen to my doctors or lawyers in matters of health or law either. I simply listen to what others tell me…. 😉 😛
If one of those previous surveys was by L. I. Smith & Associates, you just tell that woman, “I matched their survey and they are the survey emissaries of God himself. It would be un-Christian to question the location of a line they surveyed.”

I love ’em.
At my age I’ve been shot at, had the local constabulatory notified of my presence, had dogs sicked on me…I’ve been punched in the nose and had an instrument leg kicked out from under me. I’ve been shoo’d with a broom and I even had a fella that was so irate he backed his car out of the driveway to drive 600 feet down the block and run over my backsight. I don’t get near as excited as they do.
Lately (last couple of years) I’ve grown fond of letting them have their say then I get all “porky-pig” and start stuttering and acting like someone with a low I.Q. (I’d use the word “tard” but someone might get upset).
Have fun with them. It’s a blast. Try it..you’ll like it.

Just tell them it is illegal to destroy or remove your monuments, then go on to tell them that they do not have to accept your results but to to establish grounds to dispute your work, and have standing in a Court of law, they need to employ a surveyor to survey their property. Never had anyone do that, if they do, fine. Most hot headed adjoiners will run down after a time if you let them and you can leave on friendly terms if you are just a bit wiser than they are. Displaying pride, superiority and arrogance will quickly display set the trend of future contacts.

I promise not to come to Oklahoma to survey. You don’t have to try to convince me to stay out of your territory.
Tell her to call “Title Man” (Super Man’s brother?) and ask him drive out and physically show her the property lines.
